Terms & Conditions

These Terms & Conditions apply to bookings made with NuFlava Entertainment for DJ, sound, lighting, event entertainment and related services.

By confirming a booking, paying a deposit, or engaging our services, you agree to the terms outlined below.

1. Booking Confirmation

A booking is only confirmed once:

  • NuFlava Entertainment has confirmed availability;

  • the event details and package/inclusions have been agreed; and

  • the required booking deposit has been received.

Tentative enquiries or quotes do not secure a date.

2. Booking Deposit

A $200 booking deposit is required to secure your event date.

The deposit is applied toward the total booking amount and confirms that NuFlava Entertainment has reserved the agreed date and time for your event.

The booking deposit is generally non-refundable if you cancel or change your mind, as it secures your date and covers administration, planning time, communication, scheduling and loss of opportunity for other bookings.

3. Final Payment

The remaining balance is due 7 days prior to the event date, unless otherwise agreed in writing.

If final payment is not received by the due date, NuFlava Entertainment reserves the right to withhold services until payment is made.

4. Cancellations by the Client

If you cancel your event after paying the booking deposit, the deposit will generally be retained.

Any additional amounts paid may be reviewed based on:

  • the amount of notice provided;

  • work already completed;

  • planning time already invested;

  • costs already incurred;

  • whether the date can reasonably be rebooked; and

  • any other relevant circumstances.

Cancellation fees must be reasonable and proportionate to the loss or costs incurred. This approach is consistent with Australian guidance that cancellation fees and retained deposits should reflect genuine costs/losses rather than operate as a penalty.

5. Changes to Event Date, Time or Venue

Requests to change the event date, time, location or package are subject to availability and may result in additional charges.

If a date change is requested and NuFlava Entertainment is available, we will make reasonable efforts to transfer the booking deposit to the new date.

If NuFlava Entertainment is unavailable for the new date, the booking may be treated as a cancellation.

6. Client Responsibilities

The client is responsible for providing accurate event details, including:

  • event date;

  • venue name and address;

  • access times;

  • performance times;

  • run sheet or schedule;

  • venue contact details;

  • parking/loading arrangements;

  • power availability;

  • floor level or lift access;

  • outdoor/weather considerations;

  • required formalities, songs and announcements.

Any delays, restricted access, incorrect information or changes that impact setup, pack-down or performance may result in reduced performance time or additional fees.

7. Venue Access, Setup and Pack-Down

The client must ensure NuFlava Entertainment has reasonable access to the venue for setup and pack-down.

Adequate time must be provided for safe equipment setup, testing and removal.

Where difficult access is involved, including stairs, long carry distances, restricted loading zones, paid parking, after-hours access limitations or remote locations, additional fees may apply.

Parking and Loading Access

The client is responsible for ensuring suitable parking or loading access is available for NuFlava Entertainment for the duration of the event, including setup and pack-down times.

A parking space should be provided as close as reasonably possible to the venue entrance or performance area to allow safe and efficient loading of equipment.

If suitable onsite parking or loading access is not available, NuFlava Entertainment may arrange paid parking, loading access or alternative arrangements where required. Any reasonable parking, loading, access or related costs incurred may be passed on to the client.

Where restricted access, long carry distances, stairs, lifts, paid parking, loading dock restrictions or other venue access limitations impact setup or pack-down, additional fees may apply.

8. Power and Site Requirements

The client must ensure safe and suitable power is available at the performance area.

NuFlava Entertainment requires access to appropriate power outlets and a safe, level, dry and protected setup area.

If power is unavailable, unsafe or unreliable, NuFlava Entertainment may be unable to provide some or all services.

9. Outdoor Events and Weather

For outdoor events, the client must provide suitable cover and protection from weather, including sun, rain, wind, moisture and extreme temperatures.

DJ, sound, lighting and electrical equipment must not be exposed to unsafe weather conditions.

NuFlava Entertainment reserves the right to delay, relocate or stop services if weather conditions present a safety risk to people or equipment.

No refund will be provided where services are impacted due to unsafe weather conditions, unsuitable cover or inadequate site preparation by the client or venue.

10. Safety and Right to Stop Services

NuFlava Entertainment reserves the right to stop music, pause services, refuse to continue, or pack down equipment if the DJ, staff, guests, performers, equipment or any person is placed at risk.

This includes, but is not limited to:

  • aggressive, abusive or threatening behaviour;

  • intoxicated or unsafe guest behaviour;

  • physical danger to the DJ or equipment;

  • unsafe electrical conditions;

  • liquid spills near equipment;

  • unstable stage or setup areas;

  • severe weather;

  • smoke, fire or venue evacuation;

  • venue staff or security directions;

  • any situation that compromises safety.

If services are stopped due to unsafe conditions, threatening behaviour, damage risk, or failure to provide a safe working environment, no refund will be provided for the affected time.

11. Damage to Equipment

The client is responsible for any loss, damage or theft of NuFlava Entertainment equipment caused by the client, guests, except where caused by NuFlava Entertainment’s negligence.

This includes damage caused by:

  • drinks or liquids;

  • guest interference;

  • unauthorised handling of equipment;

  • physical impact;

  • unsafe venue conditions;

  • failure to follow reasonable instructions.

Repair or replacement costs may be charged to the client.

12. Music Requests and Content

NuFlava Entertainment welcomes client music preferences, must-play songs, do-not-play lists and guest requests where appropriate.

We will use professional judgement to manage the music flow and maintain the atmosphere of the event.

NuFlava Entertainment reserves the right to refuse to play songs that are inappropriate, offensive, unsafe, inconsistent with the agreed event style, or contrary to venue/client requirements.

For school events or youth-focused events, clean edits and age-appropriate music will be prioritised.

13. Event Timelines and Overtime

Performance time is based on the agreed package and booking details.

Overtime may be available by prior agreement or on the night, subject to availability, venue approval and DJ discretion.

Overtime is charged at the agreed hourly rate or as quoted.

NuFlava Entertainment is not required to perform beyond the agreed finish time unless agreed.

14. Special Effects and Enhancements

Enhancements such as cold sparklers, Dancing on a Cloud, monograms, uplighting or other effects are subject to venue approval, site suitability and safety requirements.

The client is responsible for confirming that the venue permits the requested enhancement unless NuFlava Entertainment has agreed to assist with confirmation.

NuFlava Entertainment reserves the right to assess the final placement, setup and use of all equipment and enhancements on the day of the event.

Where the requested placement or use of equipment is deemed unsafe, unsuitable or impractical, NuFlava Entertainment may reposition, modify, delay or decline the use of the equipment or enhancement without prior notice, where required to prioritise the safety of guests, staff, performers, venue property or equipment.

This may include, but is not limited to, repositioning cold sparklers, lighting, speakers, projection equipment, cables, stands or other event equipment where site conditions, guest movement, venue layout, ceiling height, fire safety, weather, flooring, access or other factors create a potential risk.

If an enhancement cannot be provided due to venue restrictions, safety concerns or site conditions outside NuFlava Entertainment’s control, we will discuss alternative options where possible.

No refund will be provided where an enhancement is modified, repositioned, delayed or unable to proceed due to safety concerns, venue restrictions, unsuitable site conditions or failure to obtain required venue approval.

15. Third-Party Suppliers and Industry Contacts

Where NuFlava Entertainment assists with arranging third-party suppliers such as photographers, entertainers, MCs or performers, those services may be subject to separate availability, pricing, terms and conditions.

NuFlava Entertainment may coordinate introductions or arrangements, but responsibility for third-party performance remain with the relevant supplier.

16. Photography, Video and Marketing

NuFlava Entertainment may capture limited photos or video of setup, lighting, effects or event atmosphere for promotional use.

We will use reasonable care when publishing content and avoid intentionally sharing inappropriate or sensitive material.

If you do not want photos or videos used for marketing, please advise us in writing before the event.

For school events or events involving minors, additional care will be taken and identifiable student images will not be used without appropriate permission.

17. Force Majeure

NuFlava Entertainment will not be liable for failure or delay in providing services due to circumstances beyond our reasonable control.

This may include:

  • severe weather;

  • natural disasters;

  • fire, flood or power failure;

  • venue closure;

  • government restrictions;

  • road closures or major transport disruption;

  • illness, injury or emergency;

  • acts of violence or public safety incidents.

Where possible, we will work with the client to reschedule or provide a suitable alternative.

18. DJ Illness or Emergency

If the booked DJ becomes unavailable due to illness, injury, emergency or circumstances beyond reasonable control, NuFlava Entertainment will make reasonable efforts to arrange a suitable replacement DJ.

If no suitable replacement can be arranged and NuFlava Entertainment is unable to provide the agreed services, any refund or remedy will be assessed in accordance with Australian Consumer Law and the circumstances of the booking.

19. Limitation of Liability

To the extent permitted by law, NuFlava Entertainment is not liable for indirect, incidental or consequential losses, including loss of enjoyment, loss of opportunity, reputational loss or losses caused by venue restrictions, client decisions, guest behaviour or circumstances outside our reasonable control.

20. Australian Consumer Law

These Terms & Conditions do not exclude, restrict or modify any rights you may have under Australian Consumer Law.

If services are not provided with due care and skill, are not fit for purpose, or are not delivered within a reasonable time where no time is agreed, you may have rights to a remedy under Australian Consumer Law.

21. Agreement

By paying the booking deposit, the client confirms they have read, understood and agreed to these Terms & Conditions.
